These terms apply to every purchase made through nome.art and shop.nome.art (the “Site”), operated by NOME ART Inc. (“NōME,” “we,” “us”). By placing an order you confirm that you have read these terms and agree to them. Details specific to each artwork or collection, including edition size, dimensions, price, what is included, and production and shipping times, are stated on the relevant page of the Site. Those details form part of these terms for your order.

Short version

You are buying a physical artwork. Copyright stays with the artist. Pieces are produced to order, so sales are final once production begins. If your piece arrives damaged or never arrives, we replace it.

1. The artwork

Each piece is an original work by NōME, produced as a physical print in the format described on its product page. Parallax printing layers more than one image in a single print, so the image shifts as you change viewing angle. Because pieces are printed, mounted and framed individually, small variations in framing, mounting and surface finish are normal and are not defects. Colors, contrast and the strength of the parallax effect look different on a screen than in person. Photographs, renders and mockups on the Site are illustrative.

2. Limited editions

Editions are limited. The edition size for each artwork is stated on its product page and is the number we are bound by. Once an edition closes, that artwork will not be reproduced again in that size or using that printing technique. We may present the image again in a substantially different form, such as a larger scale work for an exhibition or an institutional commission, but never again in the same edition format.

Each piece is supplied with a certificate of authenticity stating the title, edition number and year. Where a piece includes an embedded verification chip linked to a record on nome.art, it is provided as a convenience for verification and ownership records and is not a guarantee of resale value or of any future service.

3. Price and payment

Prices are stated on the Site in US dollars. What the price includes, such as framing, taxes or shipping, is stated on the product page. Payment is taken in full at checkout through our payment processor. We do not store your card details. Promotional codes are valid only for the period and collection stated, cannot be combined, and cannot be applied after an order is completed. We may change prices at any time. A change does not affect an order already paid for.

4. Orders and cancellation

Your order is accepted when you receive an order confirmation from us. We may decline or cancel an order, with a full refund, if the piece is no longer available, if the listing contained a pricing or description error, or if we suspect fraudulent payment.

You may cancel for a full refund within 24 hours of placing your order, before production starts. Email info@nome.art with your order number. After that window, production has begun and section 6 applies.

5. Production, shipping and delivery

Production and shipping times are stated on the product page. They are estimates, not guaranteed dates, and can be affected by carrier delays or production issues outside our control. Where a product page offers international shipping, any import duties, customs charges and local taxes are your responsibility and are not included in the price.

You are responsible for giving a complete and accurate shipping address. We are not liable for pieces lost or delayed because of an incorrect address, and reshipment in that case is charged to you.

Inspect your piece on arrival. If it arrives damaged, email info@nome.art within 2 days of delivery with photographs of the piece and the outer packaging. We will repair or replace it, or refund it if no replacement is available from the edition. If a piece is confirmed lost in transit, we will replace it or refund you in full.

6. Returns and refunds

Because every piece is a limited edition work produced to order, all sales are final and non-refundable once production has begun. We do not accept returns or exchanges for change of mind, for a piece not matching your expectations of the effect, or for delays within the estimated windows given on the product page. This does not limit any rights you have under consumer protection law that cannot be waived, and it does not apply to the damage, loss or non-delivery situations in section 5.

7. Copyright and what you own

You own the physical object. NōME retains full copyright and all other intellectual property rights in the artwork, the underlying images and all related materials. You may display your piece in your home, office or private space, photograph it in that setting, and share those photographs on social media with credit to the NōME artist.

You may not, without written permission from NōME:

• Reproduce, print, scan or photograph the artwork in order to make copies, merchandise or derivative works.

• Use the artwork or its image commercially, including in advertising, packaging, editorial or branded content.

• Use the artwork or any reproduction of it to train, fine-tune or prompt a machine learning or generative AI system.

• Mint, tokenize or issue any digital asset representing the artwork.

• Alter the piece, remove it from its frame, or remove or tamper with the certificate of authenticity or any verification chip.

Exhibiting your piece in a public or commercial exhibition requires written permission, which we do not unreasonably withhold, and correct attribution to the artist.

8. Resale

You are free to resell your piece as a physical object. When you do, pass the certificate of authenticity to the buyer and let us know at info@nome.art so the ownership record stays accurate. A resale transfers no copyright or reproduction right, and a resale price is never a representation by us about value or investment return.

9. Care

Keep the piece out of direct sunlight and away from humidity and heat sources. Clean the surface only with a dry microfiber cloth. Do not use liquids, solvents or abrasive cloths. Damage from handling, cleaning, environment or accident after delivery is not covered.

10. Collector benefits

Where a purchase includes access to a collector portal, private community or other additional benefit, that benefit is offered at our discretion, is not part of the artwork you are purchasing, and may change or end at any time without affecting your purchase or entitling you to a refund.

11. Commissions and custom work

Commissioned or custom pieces are governed by a separate written agreement covering scope, timeline, deposit and revisions. Deposits on commissions are non-refundable once work has started.

12. Limits on our liability

We provide the Site and the artwork as described in these terms and make no other warranties, express or implied. To the fullest extent permitted by law, our total liability for any claim connected to your order is limited to the amount you paid for the piece. We are not liable for indirect or consequential losses, including lost profit or any claimed loss of investment value. We are not responsible for delays or failures caused by events outside our reasonable control, including carrier disruption, supplier or production failure, natural disaster, and government action.

13. Your information

We collect the information needed to process your order and communicate with you about it, and we handle it as described in our Privacy Policy https://nome.art/privacy. We do not sell your personal information. If you send us photographs or written feedback about your piece, we may share them on our channels with credit unless you ask us not to.

14. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in Delaware or Hawaii, US. Before starting any formal proceeding, you agree to contact us at info@nome.art and give us 30 days to resolve the issue.

15. Changes to these terms

We may update these terms. The version published on the Site at the moment you place your order is the version that applies to that order.
